1. Introduction

1.1 These Terms & Conditions ("Terms") govern your use of the Mark of A ("Provider") website at www.markofa.com ("Website").

1.2 By using or purchasing from this Website, you agree to be bound by these Terms. You may not copy, share or distribute any content from this Website for commercial purposes without our written consent.

2. Electronic Communications

2.1 When you use our Website or communicate with us electronically, you consent to receiving communications from us electronically. These communications satisfy any legal requirement that such communication be in writing.

3. E-Commerce and Privacy

3.1 The use of products purchased from this Website is at your own risk. Mark of A will not be held responsible for loss, injury or damage resulting from misuse of our products.

3.2 Your personal information, such as your name, delivery address and contact number, is kept strictly confidential and shared only with third parties involved in delivering your order. We never sell or disclose your information for marketing purposes.

3.3 We take all reasonable precautions to secure your transactions. However, we are not responsible for security breaches caused by viruses or spyware on your personal device.

4. Cookies

4.1 Our Website uses cookies to improve your browsing experience and store preferences.

4.2 These cookies help us remember your choices, improve functionality and analyse overall website performance through tools such as Google Analytics.

5. Ordering

5.1 Order processing

• Orders begin processing once full payment has cleared.
• Stock-on-hand items are delivered within 3 to 4 working days.
• Made-to-order, personalised, engraved or hand-stamped items are delivered within 12 to 14 working days.
• Custom ring designs take 4 to 8 weeks and are quoted individually.
• During peak periods production times may be extended.

5.2 Order updates

You will receive email notifications as your order progresses, and a tracking number by email and SMS on dispatch.

5.3 Cancellations

• Before production begins: cancel for a full refund.
• After production has begun: a 10% administrative fee is deducted.
• Once dispatched, cancellation is not possible.

5.4 Order changes

• Contact info@markofa.com immediately for spelling, size or personalisation errors.
• If the order is already in production, a remake or correction fee may apply.
• Delivery addresses can only be changed before dispatch and may incur an additional courier charge.

6. Shipping & Delivery

6.1 Shipping fees

• Door-to-door courier within South Africa: R140
• Pudo locker within South Africa: R80
• International shipping is quoted at checkout.

6.2 Delivery times

• Orders are dispatched Monday to Friday, excluding public holidays.
• Stock on hand: 3 to 4 working days. Made to order: 12 to 14 working days.
• Mark of A is not responsible for courier delays once a parcel has left our premises.

6.3 International shipping

• We ship worldwide.
• Import duties and taxes are the responsibility of the customer.

6.4 Delivery responsibility

• We cannot deliver to P.O. Boxes.
• Someone must be available to sign for door-to-door deliveries.
• Failed delivery due to incorrect details may incur an additional shipping fee.

7. Payment Options

• Card payments (all major card types) are processed securely through BobPay.
• EFT and PayJustNow are also available at checkout.
• Your banking details are never shared with Mark of A. They are processed directly by the payment provider.
• Orders are only processed once payment has been received and verified.
• All payments are processed in South African Rand (ZAR).

8. Returns, Exchanges & Refunds

8.1 Return eligibility

• Returns must be requested within 7 days of receiving your order.
• Items must be unused and unworn, in original condition.
• Earrings and personalised, engraved, hand-stamped or custom-made items are not eligible for return or exchange unless defective on arrival.

8.2 Defective, damaged or incorrect items

• Report within 7 days of delivery to info@markofa.com with clear photographs.
• Once verified, we replace or repair the item at no cost to you.

8.3 Refund process

• Refunds are issued only after the item has been returned to our studio and inspected.
• Approved refunds are paid by EFT within 10 working days of inspection.
• Return courier costs are for the customer's account unless the item was faulty or incorrect.
• Delivery fees are not refundable.

9. Materials, Care & Warranty

• Our jewellery is handcrafted, so slight variations between pieces are natural.
• Gold-plated stainless steel pieces are tarnish proof and suitable for daily wear, including water.
• Sterling silver is a natural material and will tarnish over time with wear, moisture and skin chemistry. This is normal and is not a defect. Silver can be cleaned and restored.
• We do not offer a warranty on general wear and tear.
• Chains are delicate and breakage is not covered, but chains can be replaced at a cost.
• We offer cleaning, re-plating and resizing services. Contact us for a quote.

10. Intellectual Property

All images, text and designs on this Website are owned by Mark of A. You may not reproduce or distribute any content without our written consent.

11. Governing Law

These Terms are governed by the laws of South Africa. All payments are processed in South African Rand (ZAR).

12. Updates to Terms

Mark of A reserves the right to modify these Terms at any time without prior notice. Please review them periodically. Continued use of the Website constitutes your acceptance of any changes.
